DEAR Part 909 covers contractor qualifications. Prove Qualifications Before You Promise Eligibility.
Your parent company has money, your name does not appear excluded, and your team knows the requirement. Those facts do not settle contractor qualifications. Responsibility, financial support, conflicts, and program applicability require separate evidence before your company promises it is eligible.

Verify the Operative Qualification Sources
Use current codified sources and applicable DOE and NNSA deviations together. DOE's May 2026 deviation addresses this part and related disclosure and conflict terms. Confirm the PDF's actual contents, operative scope, and later supersession rather than relying on an attachment label.
Agency qualification procedures differ from contractor obligations under applicable law and contract. Separate responsibility, exclusions, organizational conflicts, and any applicable workplace program. Each asks a different question; satisfying one does not establish that the others are resolved or irrelevant to the acquisition.
For work covered by the applicable workplace substance abuse regulation, the prospective contractor must agree to provide the required written program to the contracting officer, consistent with the specified clause framework. Do not extend that requirement automatically to every DOE purchase or business.
Verify Enforceable Financial Support
For newly created entities, such as joint ventures, third party financial resources require legally binding performance guarantees or equivalent enforceable commitments and sufficient resources under the applicable responsibility framework. A parent's reputation or an affiliate's marketing statement is not the same evidence.
Exclusions can involve companies, key personnel, or agents under the applicable rules. Agency personnel review the System for Award Management at required stages.
Absence of an exclusion does not prove responsibility. Needing a contract does not authorize a company to disregard an exclusion or waive a qualification issue. Keep database evidence distinct from the broader performance, financial, and other responsibility facts required for the acquisition.
Analyze Organizational Conflicts Separately
Organizational conflicts require a separate analysis of interests, relationships, information, and work. The framework calls for avoiding, neutralizing, or mitigating relevant conflicts. Identify the actual concern instead of declaring every affiliate relationship prohibited or treating a company assurance as a complete mitigation decision.
Before withholding award on organizational conflict grounds, the applicable process includes contracting officer notice of reasons and an opportunity to respond. Read the actual notice and instructions. Do not invent a universal response period or assume informal discussions preserve the required response opportunity.
A conflict waiver is an authorized agency decision under the applicable process, not a contractor declaration. Verify the current Senior Procurement Executive authority and required route with qualified support. A customer's preference or internal legal memorandum does not independently establish that the Government granted a waiver.
Check Disclosure and Conflict Prescriptions
Disclosure and conflict terms have specific prescriptions, including covered advisory and assistance services above the simplified acquisition threshold and certain site operation or environmental remediation contracts outside the management and operating framework. Check the actual prescription; these are not universal clauses for every award.
The disclosure provision addresses relevant past, present, and planned interests. Prepare a supported account of relationships rather than a narrow statement about today's project alone. Verify the required disclosure period and any authorized extension instead of adopting a universal lookback or submission deadline.
The conflict clause can require immediate full written disclosure after award when relevant facts change. This is more than a one-time certification. Establish who detects changed interests, reviews them, and sends the required information through the actual contract process.
Read applicable constraints on future participation, work products, and nonpublic information. Where the specified alternate is incorporated, evaluate its subcontract requirements and triggering conditions. Do not assume every subcontract receives identical restrictions or that ordinary confidentiality procedures settle organizational conflict concerns.
Fictional Example: Juniper Basin Analytics
Consider a clearly fictional company, Juniper Basin Analytics. It advises DOE on requirements and wants an affiliate to bid for implementation work. Its newly created bidding entity also points to a parent's financial strength. Management proposes calling both qualifications and conflicts resolved through that relationship.
Juniper separates the resource issue from the conflict issue. Finance and counsel examine whether the bidding entity has sufficient resources and an enforceable support commitment. They do not replace a required guarantee with an affiliate presentation or assume a parent must fund performance without obligation.
Contracts maps the advisory work, affiliate interests, access to nonpublic information, and proposed implementation role. The team reviews applicable disclosure and conflict terms and seeks the authorized written decision. It neither declares automatic ineligibility nor promises that informal separation of personnel guarantees acceptance.
Build a Traceable Qualification Package
Build an eight-field qualification worksheet. Retain supporting records and identify who verifies each entry. A useful package should show what is established, what remains unresolved, and which agency decision is still needed before an eligibility statement is made.
Field one is Entity and Solicitation. Identify the actual bidder and acquisition. Field two is Responsibility Evidence. Link capability, performance, and applicable program support to that entity rather than substituting an affiliate's credentials or assuming a general corporate profile answers every qualification question.
Field three is Resources and Enforceable Support. Retain sufficient resource evidence and any required binding commitment. Field four is Exclusion Review. Record the relevant checks, dates, and unresolved relationships.
Field five is Relevant Interests and Affiliates. Map the relationships and work affecting conflict review. Field six is Governing Provision or Clause. Identify the actual wording, applicability, alternate, and continuing requirements instead of applying a generic conflict certificate to every transaction.
Field seven is Mitigation and Written Decision. Retain the proposed measures and authorized response without presenting a pending request as approval. Field eight is Owner and Continuing Disclosures. Assign responsibility for changed facts, required written reports, and follow through under the actual terms.
Three Operating Questions
Ask three operating questions. What evidence supports this entity's responsibility and any required financial commitment? Which interests or relationships require disclosure or conflict review? What authorized decision and continuing contract duties remain? Resolve uncertainty before turning a business plan into an unsupported eligibility assurance.
